Tobacco Company RJ Reynolds Must Pay $23.6 Billion In Lawsuit Brought By Smoker's Widow

MIAMI (AP) — A Florida jury has slammed a tobacco company with $23.6 billion in punitive damages in a lawsuit filed by the widow of a longtime smoker who died of lung cancer in 1996. The case is one of thousands filed in Florida after the state Supreme Court in 2006 tossed out a $145 billion class action verdict. That ruling also said smokers and their families need only prove addiction and that smoking caused their illnesses or deaths. The damages a Pensacola jury awarded Friday to Cynthia Robinson after a four-week trial come in addition to $16.8 million in compensatory damages. Robinson individually sued R.J. Reynolds Tobacco Co. in 2008 on behalf of her late husband, Michael Johnson Sr. Her attorneys said the punitive damages are the largest of any individual case stemming from the original class action lawsuit. It clearly implied that even meager restitution was underserved and we were unworthy plaintiffs, although we successfully proved racial discrimination in federal farm loan practices. The headline was an immediate giveaway, (no pun intended) that this story intended to make a case against legally won payments to offset generations of injustice in federal farm loan practices. Chubby Checker (real name Ernest Evans) has filed suit in Saint Lucie County (Fla.) Federal Court this week, alleging that Hewlett Packard and its subsidiary Palm, Inc. didn't have permission to maintain the app called "The Chubby Checker." According to a press release on MarketWatch, the 71-year-old's lawyer Willie Gary claims Hewlett Packard and Palm did not act quickly enough to take down the penis-measuring app, and that by doing so, damaged Checker's reputation: "The "app" adversely affects Chubby Checker's brand and value and if allowed to continue, will cause serious damage to the Plaintiff's goodwill and will tarnish his image that he has worked to maintain over the last 50 years," the release states. Gloria, his childhood sweetheart, now wife, assisted him at this newly formed law firm. Gary was the first black male to go to college from the small town of Indiantown where his family labored in the cane fields. He is known to still speak of the tiny shack where he lived in the Silver City settlement of Pahokee, Florida, and says he often drives by the shack with a clear vision of those times. With Gloria he has four adult sons: Kenneth, Sekou, Ali and Kobie. Kenneth is president & CEO of The Gary Foundation and Gary Enterprises (the family’s real estate management company). Sekou is a member of the Florida Bar and recently opened his own law practice, Gary Legal Group LLC, in Miami, Florida. Ali earned his Bachelor’s Degree in Business Administration and is Editor and Chief of “Update,” the firm newsletter. Kobie, is a graduate of Nova Southeastern University located in South Florida.
