Terms of Use

Spokeo (or Spokeo.com or Spokeo, Inc.) is a people search service that aggregates and organizes people-related information from phone books, social networks, marketing surveys, real estate listings, business sites, and other publicly available sources. By accessing Spokeo.com or the information made available through Spokeo.com in any way, you agree to be legally bound by the following terms and conditions.

Spokeo reserves the right to change, modify, update, add, or remove portions of these terms and conditions at any time, with or without prior notification. Any change to these terms and conditions will be posted here, so please check back periodically.

1. AGE AND ELIGIBILITY

Children under the age of 18 are not permitted to use Spokeo.com. You warrant that you are 18 or older and that you agree to all the terms and conditions of this Agreement.

2. CONDITIONS OF USE

You agree not to use Spokeo.com, or the information made available through Spokeo.com, for any purpose that is illegal, inappropriate, or questionable. You further agree to abide by all applicable local, national, or international laws and are solely responsible for all acts or omissions that occur under your account. By way of example, and not as a limitation, you agree NOT to use Spokeo.com or the information made available through Spokeo.com:

a. to abuse, harass, stalk, defame, threaten, or otherwise violate the rights of others.

b. to send or transmit any unsolicited or unauthorized promotional materials or communication, including but not limited to ‘junk mail’, ’spam’, ‘unsolicited calls’, and ‘pyramid schemes’.

c. to conduct marketing or sales activities, including but not limited to making telemarketing calls, transmitting unsolicited paper mail, facsimile messages, text messages, email messages, or any other type of messages

d. to use or attempt to use another’s account, service or system without explicit authorization from the original owner of the account or Spokeo, Inc.

e. to cause, allow, or assist machines, bots, or automated services to access or use Spokeo.com without the express written permission of Spokeo, Inc.

f. to use or access Spokeo.com in any unauthorized manner that could damage, disable, overburden or impair Spokeo.com service.

SPOKEO IS NOT A CONSUMER REPORTING AGENCY AS DEFINED IN THE FAIR CREDIT REPORTING ACT. Spokeo aggregates information from marketing databases, social networks, and other proprietary sources for the specific purposes of locating and/or verifying individuals, properties, and businesses. The information made available on Spokeo.com shall NOT be used to furnish consumer reports.

3. PREMIUM SUBSCRIPTION

To gain full access to Spokeo’s content and tools, you may choose to upgrade to a Spokeo premium subscription. Spokeo offers a range of premium plans and special promotions at various prices and payment periods (monthly, quarterly, semi-annually, and annually). Restrictions and limitations may apply to each subscription plan, and you are responsible for reading through the details of each plan.

To open a premium subscription account, you must enter a valid credit card and/or other payment information needed to process your subscription payments. By purchasing Spokeo services, you certify that you are an authorized user of the credit card or payment account. Spokeo does not store or process your full credit card information. Instead, we employ an independent and reputable third-party payment processor to ensure the highest security standards.

Unless otherwise indicated in your plan details, Spokeo will automatically renew your premium subscription at the same payment period and term, and charge your credit card or Paypal account at the beginning of each payment period. Your premium account will remain open and active until your account is canceled, suspended, or terminated. You may cancel your subscription account at any time and for any reason. If you encounter any problem during the cancellation process, please contact our Customer Service.

4. ACCOUNT CANCELLATION

You may choose to cancel your premium or non-premium account at any time and for any reason. To cancel your premium subscription, please go to your Account Settings or Paypal account. Once your premium subscription has been canceled, you will receive a cancelation confirmation from Spokeo, Inc. or Paypal directly, and you will not be billed again. You will continue to enjoy all premium content and benefits until the end of the current payment period. To cancel and delete your non-premium account, please go to the Account Deactivation page.

If Spokeo, Inc. has been notified by third parties that any of your activities may infringe third-party rights or violate any applicable laws or regulations, Spokeo, Inc. reserves the right to terminate or suspend your account at any time without your prior permission.

5. REFUND POLICY

All sales of all Spokeo premium subscriptions are final. Spokeo does not offer any free trial periods or money back guarantees. All Spokeo, Inc. premium subscriptions are prepaid for the payment period selected (monthly, quarterly, semi-annually, and annually) and are non-refundable. When you cancel your account, any processed payment will not be refunded or prorated for partial-month usage. Your account will remain active until the end of the current payment period.

In the event that you have a problem or difficulty with Spokeo, Inc., please contact our Customer Service right away. You must make a good faith effort to work out problems with us directly before invoking legal process. Likewise, we will make our best business efforts to resolve disputes with you before we take other steps.

6. PRIVACY POLICY

Spokeo, Inc. respects the privacy of its users and non-users. The complete Privacy Policy can be found here. By accessing Spokeo.com and its associated content in any way, you agree to be legally bound by the terms and conditions listed in the Privacy Policy.

7. LINKS TO OTHER WEB SITES

Spokeo.com contains links to other Web sites, and the inclusion of such links is authorized by its users. To the extent that you authorize the connection to any third-party Web sites or systems through Spokeo, Inc., you agree that you will comply with all the Terms of Use for such Web sites. Spokeo, Inc. is not responsible for the contents of any linked Web site or the acquisition of such contents. Spokeo, Inc. is also not responsible or liable for any loss or damage of any kind incurred as the result of any such dealings. YOU REMAIN SOLELY RESPONSIBLE FOR THE MATERIALS THAT YOU AUTHORIZED SPOKEO, INC. TO OBTAIN.

Spokeo, Inc. reserves the right, but has no obligation, to monitor any material displayed on Spokeo.com. Spokeo, Inc. also reserves the right to remove any material that, in its sole discretion, violates these Terms of Use.

8. ELECTRONIC COMMUNICATIONS

When you visit Spokeo.com or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically, including but not limited to purchase receipts, confirmation notices, and welcome messages. You agree that all notices, agreements, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

‘Spokeo’ is a registered trademark of Spokeo, Inc. All other trademarks, trade names, service marks, service names are the property of their respective holders. This Web site is not endorsed by or affiliated with American Online, Bebo, BuzzNet, CNet, DailyMotion, DeviantArt, Digg, Facebook, Flickr, Flixster, Fotolog, Friendster, GoodReads, Google, Hi5, ICQ, ILike, ImageStation, IMeem, Last.fm, LinkedIn, LiveJournal, Microsoft, Multiply, MySpace, NetLog, News Corp., Pandora, PhotoBucket, Picture Trail, Piczo, Six Apart, Slide, Sony, StumbleUpon, Tagged, Twitter, Webshots, Wretch, Xanga, Yahoo, Yelp, and YouTube.

DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES REGARDING THE PERFORMANCE OF THE SERVICE AND THE ACCURACY, FRESHNESS, OR COMPLETENESS OF THE INFORMATION, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. In no event shall Spokeo, Inc. be liable for any special, indirect, or consequential damages, or any damages whatsoever resulting from loss of use, data, or profits, arising out of or in connection with the use of this Web site or information available from this Web site.

Spokeo, Inc. aggregates mostly US-based data and does not guarantee results for non-US residents. Spokeo, Inc. does not yield non-US search results for both name and phone searches. However, Spokeo, Inc. will yield non-US search results for email searches.

11. HOLD HARMLESS AND INDEMNITY

You agree to hold harmless and indemnify, and at times defend, Spokeo, Inc. and its affiliates, officers, agents, co-branders, partners, and employees from any claim or demand made by any third party due to or arising out of your use of this Web site, your connection to this Web site, your violation of these Terms of Use, or your violation of any rights of other users.

12. MISCELLANEOUS

By accessing this Web site, you agree that the statutes and laws of the United States and the State of California will apply to all matters relating to the use of this Web site, and you further agree that any litigation shall be subject to the exclusive jurisdiction of the state and federal courts in the County of Los Angeles, USA. The failure of Spokeo, Inc. to exercise or enforce any right or provision of the Terms of Use does not imply a waiver of such right or provision.
